The Department of Commerce and Consumer advises before the 'Black Friday' (20/11/2019)

The 'Black Friday', a day in which large and small businesses apply discounts before the start of Christmas shopping, is just around the corner.

Before this very important day for the buyers that is celebrated next Friday, November 29, the Department of Commerce and Consumption wants to offer a series of tips to face it.

"It is the day of greatest offers in the year and we have to know our rights and the guarantees of the products so as not to fall into the deception when making your purchases online or in establishments and avoid problems," explains the first deputy mayor, María Ángeles Fernández Fernández.

"According to a report by Googlese, this day expects sales of around 1.6 billion euros, that is, 10% more than in 2018, where each buyer will spend around 256 euros," explains the head of the Municipal Information Office at Consumer (OMIC), Francisco Juan Sánchez, who advises that in the case of purchases of technological products, websites specialized in technology are visited previously to buy your products.

Seller ID

The e-commerce companies operating in Spain have a legal obligation to publish on their website the data referring to their company name, NIF, postal address and contact information.

On platforms such as eBay or similar, where transactions are made between individuals, it is important to look at the ratings of the seller and the opinions of other users.

Knowing your reputation provides some guarantee of how the purchase process will take place.

In case of doubt, it is best to communicate with the seller through their contact information.

Secure transaction

When you buy over the Internet, you must take the same security precautions as when you make banking transactions, that is, use secure connections and have security or antivirus software installed on the device from which you made the purchase.

Before entering bank details on any website it is necessary to verify that you have a recognized security certificate.

In the top bar of the browser, where the URL of the web page is placed, the "http: //" must be transformed into https: // if your data is being encrypted and, therefore, are protected.

Payment Methods

Employers may not invoice consumers and users, for the use of certain means of payment, charges that exceed the cost borne by the employer for the use of such means.

The online store must give the option to pay in the way that suits us (by credit or debit card, by bank transfer, PayPal ...) without this implying an extra cost.

If the seller cannot fulfill the promised period, he has the obligation to notify you and you can decide if you continue with the operation or if you give up without this entailing an additional cost.

In this case, the seller is obliged to return the money immediately.

The General Law for the Defense of Consumers and Users establishes that, in case of unjustified delay, the user may claim to be paid twice the amount owed.

Returns and withdrawal

The Law protects your rights to withdraw from the purchase within 14 days of receiving the product or contracting a service without giving any justification.

If the information on withdrawal is not available on the web, or has not been communicated when making the purchase, the withdrawal period is extended up to 12 months, without implying any type of penalty or additional expenses.

If it was not clearly indicated that in case of return shipping costs are borne by the buyer, the seller will have to take care of them.

Guarantee

When you buy through the Internet, the products or goods purchased are protected by the same guarantees as if they had been purchased at a store or physical store.

When you receive a product, you should check the status in which the package arrives.

If it was damaged or beaten, you can return it indicating the reason or sign the acknowledgment of the courier by leaving written record that it shows visible external damage.

Claims

If you have a problem, the first step is to try to solve it through the seller's customer service.

Faced with ridiculously attractive prices, it is best to distrust: it may be a mistake or a fraud.

Given this, it is best to seek references from the seller before making the payment to avoid being a victim of a scammer.

If the offer is from a recognized trade, it is most likely an error.

Even if you pay, if you have not received the purchased product the merchant could try to stop the buying and selling process by explaining that it has been a misunderstanding.

In this case, you would have the option to file a complaint with the Consumer agencies.

When you make your purchases in the establishments, check that in the main entrance it shows the logo of Consumer Arbitration.

The conflicts that arise between a consumer and a company can be resolved through the arbitration system of consumption, an extrajudicial, free, simple and voluntary service.
